          Abstract

          Resumen El presente artículo tiene como objetivos presentar las bases teóricas y prácticas del Constitucionalismo Intersistémico. Para ello, se realiza un recorrido por la teoría constitucional, demostrando la evolución de la concepción de Constitución en sus dos fases. En este tema, se señalan decisiones relevantes de la jurisdicción constitucional de Alemania, Brasil y Francia para dilucidar dicha evolución. Además, en este mismo apartado se destacan las insuficiencias de la teoría constitucional para observar nuevos problemas jurídico-constitucionales, elevados al nivel de la sociedad mundial. En este punto, se seleccionan casos que involucran a distintos países latinoamericanos, en especial a Brasil, pero cuya repercusión fue global. Una vez identificado este problema, se presentan elementos de la sociología jurídica aptos para resolver la problemática mencionada, destacando entre estos la vinculación heterárquica de las organizaciones con los derechos fundamentales y la gobernanza. Como hipótesis, en las conclusiones se sostiene la imprescindibilidad de una racionalidad constitucional intersistémica, que reúna elementos de la teoría constitucional y de la sociología jurídica para enfrentar los desafíos actuales del derecho constitucional. La metodología aplicada es sistémica, utiliza la técnica de investigación de documentación indirecta, con revisión de bibliografía nacional y extranjera.

          Translated abstract

          Abstract The purpose of this article is to present the theoretical and practical foundations of Intersystemic Constitutionalism. For this purpose, a review of constitutional theory will be made, showing the evolution of the concept of the constitution in its two phases. In this topic, relevant decisions of the constitutional jurisprudence of Germany, Brazil and France will be pointed out to elucidate this evolution. Furthermore, in the same section, the inadequacies of Constitutional Theory to observe new legal-constitutional problems, raised to the level of the world society, are highlighted. At this point, cases are selected that involve different Latin American countries, especially Brazil, but whose repercussions have been global. Once this problem has been identified, elements of legal sociology suitable for solving the aforementioned problem are presented, highlighting among them the heterarchic linkage of organizations with fundamental rights and governance. As a hypothesis, in the conclusions it is argued that an intersystemic constitutional rationality is essential, bringing together elements of Constitutional Theory and Legal Sociology to face the current challenges of Constitutional Law. The methodology applied is systemic, using the technique of indirect documentary research, with review of national and foreign bibliography
