          Abstract

          Resumo Este artigo investiga continuidades e rupturas entre os processos constituintes de 1823 e 1824. Para certa historiografia, a dissolução da Assembleia Constituinte significou a expressão de um arbítrio imperial rebelado contra uma Assembleia de natureza liberal. O Brasil teria perdido a oportunidade de se fundar tendo um compromisso liberal como base da relação entre governo e sociedade. Verifica-se, porém, do ponto de vista do discurso que se tornou hegemônico na Constituinte, a predisposição a instituir o Poder Moderador e a flexibilizar garantias constitucionais. Seria o preço a pagar para manter a ordem e fugir dos perigos da anarquia. A inspiração político-filosófica da Constituinte também não era diferente da existente na futura Constituição outorgada por D. Pedro I: um liberalismo romântico com traços restauradores. Conclui-se que as linhas de continuidade entre o projeto de Constituição da Assembleia destituída e a Constituição do Império sobressaem mais que as rupturas.

          Translated abstract

          Abstract This article investigates continuities and ruptures between the constituent processes of 1823 and 1824. Certain historiographical branches regard the dissolution of the Constituent Assembly as the manifestation of imperial authority against a liberal Assembly. In this perspective, Brazil would have lost the opportunity to birth itself with a liberal pact as the basis for the relationship between government and society. However, the hegemonic discourse in the Assembly suggests a predisposition to institute the Moderating Power and make constitutional guarantees more flexible. This was the price to be paid to maintain order and escape the dangers of anarchy. The Constituent’s political-philosophical inspiration was no different from that of the future Constitution imposed by D. Pedro I: a romantic liberalism with restorative traits. In conclusion, the similarities between the constitution project of the dissolved Assembly and the Constitution of the Empire outweigh the divergences.
