El Otro y su falta: aproximaciones a una teoría lacaniana del campo jurídico Translated title: The Other and his Lack: Approaches to a Lacanian Theory of Legal Field

Abstract

Resumen En este artículo se realiza una indagación hermenéutica en la que se articulará el concepto lacaniano de campo del Otro con la noción kelseniana de sistema jurídico. Se sostendrá que así como el campo del Otro tiene un carácter paradójico, como un lugar en el que se supone el lenguaje y como una falta inherente al mismo, el sistema jurídico puede entenderse de manera analógica, como un campo en el que se suponen las respuestas jurídicas, y como un lugar fundado en sus propias contradicciones. Como resultado, se obtuvo que el concepto de campo del Otro se puede observar en tres escenarios donde Kelsen identifica las inconsistencias del derecho, a saber, la dinámica jurídica, la ausencia de un metalenguaje en la interpretación y la Norma Fundamental. Al final, se concluirá que son precisamente estas inconsistencias las que permiten el funcionamiento del derecho.

Translated abstract

Abstract This paper is a hermeneutic inquiry where it will be related de Lacanian concept of Other´s field with the Kelsenian concept of legal system. It will be argued that just as the field of the Other has a paradoxical nature, as a place where language is supposed and as an inherent lack within it, the legal system can be understood in an analogous manner, as a field where legal responses are supposed and as a place founded on its own contradictions. As a result, it will be achieved that the concept of the Other´s field can be observed in three scenarios where Kelsen identifies the inconsistencies of Law, namely, the legal dynamics, the absent of a meta-language in legal interpretation, and the Basic Rule. At last, it will be concluded that they are precisely these inconsistencies that allow the work of the Law.
