Abstract

Se replantea el tema clásico de los límites metajurídicos que según el constitucionalismo y la teoría política, más que el texto expreso de una Constitución, existen para el poder constituyente originario democrático en el marco del proceso de globalización económica y jurídica. Según el autor, la globalización de los derechos fundamentales, de los principios consubstanciales a la democracia, y del ius cogens así como la muticulturalización del Estado-Nación, establecen nuevos límites al poder constituyente originario de modo que sólo puede hablarse de irregularidad del mismo cuando viola esos límites. En todas las demás esferas no es susceptible de limitaciones normativo-jurídicas, no genera dictadura de la mayoría y tiende a confundirse con la idea de democracia directa.

Translated abstract

The classical subject of the metalegal limits is reframed that according to the constitucionalism and the political theory, more than the express text of a cons-titution, within the framewok exists the democratic original constituent power of the process of economic and legal globalization. According to the author, the globalization of the fundamental rights, the inherent principies to the democracy, and of the ius cogens, as well as the multiculturalization of the State-Nation, establish new limits to the original constituent power, so that only can be spoken of irregulary of itself, when it violates those limits. It doesn't genérate dictatorship of the majority and it tends to be confused with the idea of direct democracy.
